§ 1. Organiser, partner and Event
- The organiser of the “Cyprus Private & Exclusive Investment Event” (the “Event”) is AVATARLAND spółka z ograniczoną odpowiedzialnością, a Polish limited liability company with its registered office in Poznań at ul. Trybunalska 46, 60-325 Poznań, Poland, entered in the register of entrepreneurs of the National Court Register under KRS number 0000099765, tax identification number (NIP) 7792167451, with a share capital of PLN 505,000.00 (the “Organiser”). Event contact: info@MocneStronyCypru.pl.
- The Event partner, for whose benefit the marketing activities described in these Terms are undertaken, is XPADIA LTD, a private limited company incorporated under the laws of the Republic of Cyprus, registered on 6 March 2023 with the Registrar of Companies of the Republic of Cyprus under number HE 444439, with its registered office at Mykinon 12, Floor 6, 1065 Nicosia (Lefkosia), Cyprus; correspondence address: Labs Tower, 4 Fotie Pitta, 1065 Nicosia, Cyprus; EU VAT number: CY60014811J (“XPADIA”).
- The Event will take place on 6 October 2026 from 18:00 to 22:00, Warsaw local time, at Skyfall Warsaw, on the 46th floor of the Warsaw UNIT building, rondo Daszyńskiego 1, Warsaw, subject to § 5.
- The Event is a private information and business networking meeting concerning investment opportunities in Cyprus and the development of business relationships. Attendance does not oblige anyone to purchase services or make an investment.
- These Terms govern expressions of interest, attendance confirmations and participation in the Event, as well as photography, filming and marketing contact. A “Participant” means an adult holding a personal invitation whose attendance has been confirmed in accordance with § 2.
§ 2. Invitations and registration
- Attendance is free of charge and restricted to people who are at least 18 years old on the date of the Event. Invitations are personal, non-transferable and do not include accompanying guests.
- A person without an invitation may submit the expression-of-interest form, providing their first and last name, company or organisation, position, contact details and reasons for wishing to attend. Applications are reviewed individually, taking into account the nature of the Event and the availability of places.
- Submitting an expression of interest or receiving an acknowledgement that it has been delivered does not constitute an invitation or a reservation. The Organiser separately informs applicants if an invitation is granted.
- A person holding a personal invitation confirms attendance using the RSVP form available at mocnestronycypru.pl or cyprusadvantage.eu. They provide their first and last name and either their own contact details or those of a designated office contact or assistant. In the latter case, the contact person's first and last name must also be provided.
- The expression-of-interest form is used only to assess an application: it does not require acceptance of these Terms or collect image or marketing consent. After receiving an invitation, the guest completes the RSVP form, accepts these Terms and may make separate image and marketing declarations under § 6 and § 7. Accurate information must be provided in both forms; privacy information is available next to each form.
- Where a registration is submitted by an authorised person, such as an assistant, that person provides the Participant with these Terms and the privacy information. Authorisation to handle organisational matters does not itself authorise consent to the use of the Participant's image or to marketing through the Participant's personal contact details.
- Attendance is confirmed after the Organiser verifies the personal invitation and the validity of the RSVP. Confirmation is sent to the designated contact email address. A form acknowledgement that information has been submitted does not replace this verification.
- At entry, the Organiser or venue staff may check the name against the guest list and verify that the person is an adult by asking to see an identity document. For this verification, the document is not copied, photographed or scanned, and its number is not recorded.
- A Participant may not independently transfer their invitation to another person. A change of guest requires the Organiser's prior approval and a separate personal invitation.
§ 3. Scope of attendance and organisational contact
- Free attendance includes access to the Event programme and benefits expressly identified by the Organiser as provided to guests. These Terms do not guarantee unlimited drinks service or access to all venue attractions.
- Participants bear their own travel, accommodation and other independently arranged costs. Additional purchases at the venue may incur charges only after the Participant has been informed in advance that they are chargeable, has been told the price and has ordered them.
- The Organiser and XPADIA may send information necessary to process a registration and arrange attendance, including confirmations, arrival and entry instructions, programme changes or cancellation notices. Such communications will not contain unsolicited marketing offers.
- Where contact through an office or assistant has been selected, organisational communications follow that preference. That person's details are not automatically used for marketing.
§ 4. Safety and use of Skyfall Warsaw
- Participants must follow lawful instructions from venue staff, security and the Organiser concerning safety, order and use of the premises. They must respect the dignity, privacy and safety of other people.
- Smoking cigarettes and e-cigarettes is prohibited throughout Skyfall Warsaw, including its terraces, and throughout the Warsaw UNIT building.
- Weapons, imitation weapons, bladed weapons, explosives, pyrotechnics and other flammable materials, intoxicants, substances harmful to health and items that may endanger people or the premises are prohibited. Guests may not bring their own alcoholic or non-alcoholic beverages.
- Alcohol may only be consumed by adults, in designated areas, and must be supplied through Skyfall Warsaw's drinks service. People who are visibly drunk or intoxicated may not remain on the premises. Staff may refuse alcohol service in accordance with the law and venue rules.
- Participants may only use spaces, entrances and lifts designated by staff. They must not independently access other floors or areas closed to guests.
- On the terraces, leaning beyond protective barriers, throwing objects off the terrace and other conduct that endangers safety are prohibited. Venue equipment must not be damaged, destroyed or removed.
- Use of the glass viewing terrace with a falling floor is permitted only if the attraction has been made available to guests, with the permission and in the presence of an authorised Skyfall Warsaw staff member, and in accordance with their instructions and the attraction's separate rules. Access may be restricted for safety reasons. Attendance at the Event does not require use of this attraction.
- In the event of fire, an alarm or another emergency, Participants must follow announcements and staff instructions and leave the building via the designated evacuation route. Any lawful sanitary or personal-protection instructions communicated to guests must be followed.
- Outer garments must be left in the designated cloakroom. Documents, money, electronic devices and other valuables should be removed from garments left there. This provision does not exclude liability for belongings to the extent required by applicable law.
- Aggressive behaviour, harassment, disruption of the Event and infringement of other people's rights are prohibited. Serious or repeated breaches may result in refusal of entry or a request to leave the premises by authorised staff. Immediate action may be taken in the event of an imminent threat.
- Organised advertising campaigns, displays and mass distribution of promotional materials require prior agreement with the Organiser. This restriction does not prevent ordinary business conversations or the voluntary exchange of business cards between guests.
- Participants are liable for damage they cause in accordance with applicable law. These Terms do not impose contractual penalties for breaches of venue conduct rules or automatic liability for other people's actions.
§ 5. Withdrawal, changes and cancellation
- A Participant may withdraw from attending without charge by notifying the Organiser at info@MocneStronyCypru.pl. The Organiser asks for notice as early as possible so that the place can be offered to another invited guest.
- The Organiser may make justified changes to the programme, the order of sessions or speakers, provided that these do not change the essential nature of the Event.
- The date or venue may be changed, or the Event shortened or cancelled, for important reasons, including safety concerns, venue unavailability, decisions by competent authorities or other circumstances preventing the Event from being held lawfully and safely.
- The Organiser will promptly notify Participants of material changes using their designated contact email address and update the website. A Participant may withdraw from the changed Event without any charge.
- Provisions concerning changes or cancellation do not exclude or limit rights arising under mandatory provisions of applicable law.
§ 6. Photography, filming and use of Participants' images
- Photography and video recording are planned during the Event by people engaged by the Organiser or XPADIA. The purpose is to prepare and publish coverage of the Event as part of XPADIA's marketing communications, exclusively through the channels listed below.
- Recording and using a Participant's identifiable image for this purpose requires their separate consent on the terms set out in this section. Attendance, acceptance of these Terms or failure to object to the presence of a photographer does not replace that consent.
- Consent covers recording the Participant's image without remuneration in photographs and videos made during the Event, preparing and storing those materials, and publishing them exclusively on XPADIA's website at www.xpadia.com and the official XPADIA LinkedIn profile. Publication online means that the materials may be accessible to audiences worldwide. Publication on other profiles or websites requires separate consent.
- Use is permitted no later than the end of 6 October 2028, unless the Participant withdraws consent earlier. After that date, materials showing the Participant's identifiable image will be removed from channels controlled by XPADIA or modified so that the Participant is no longer identifiable. Merely refraining from new publications is not sufficient to meet this obligation.
- Consent does not cover printed advertising materials, paid advertising campaigns, AVATARLAND's own marketing or the marketing of other partners. It does not authorise the creation of a synthetic image or voice of the Participant, biometric identification or portraying the Participant as endorsing a particular investment or service.
- Technical editing, such as cropping, brightness, colour and sound correction, editing sequences and adding Event or XPADIA branding, is permitted provided that it respects the Participant's dignity and does not misrepresent the context of their attendance. An interview or recorded statement intended for publication requires a separate agreement with the Participant; these Terms do not provide blanket consent to publishing private conversations.
- Image consent is optional. Refusing or withdrawing consent does not affect the right to attend the Event and does not incur any charge. Participants may communicate a refusal before the Event or at entry. The Organiser will inform the photography and video team and provide a way to respect that choice. Notifying staff at entry is not a condition for an earlier refusal to be effective.
- Consent may be withdrawn at any time by emailing info@xpadia.com, through info@MocneStronyCypru.pl or by writing directly to XPADIA at the correspondence address in § 1. It is sufficient to state that the request concerns image use and provide information enabling the person and the relevant material to be identified, where known. No reason, qualified electronic signature or copy of an identity document is required.
- Withdrawal does not affect the lawfulness of earlier processing based on valid consent. Following withdrawal, XPADIA will stop further marketing use of the image and, without undue delay, remove or anonymise it in materials under its control. Removal of every independent copy previously made by internet users cannot be guaranteed. This does not release XPADIA from its legal obligations, including notifying recipients where applicable.
- Photographers, videographers and editors may process the materials only to perform their commissioned work. The Participant's consent does not authorise use in their own portfolios or marketing. Any separate security CCTV at the venue is governed by its controller's rules and is not covered by this consent.
§ 7. Consent to marketing contact by XPADIA
- After the Event has ended, XPADIA intends to contact Participants to present its services, business cooperation opportunities and future events concerning investment and business activity in Cyprus. Subject to the Participant's valid marketing consent and applicable law, XPADIA may send marketing communications through any communication medium or channel permitted by applicable law, including telephone calls, email, SMS, MMS, WhatsApp, other instant messaging or electronic messaging services, postal communications, online or digital communication channels and other communication technologies that may become available.
- Marketing consent is optional. In the RSVP form, the Participant may provide a separate, not pre-selected consent authorising XPADIA to contact the Participant for the marketing purposes described in § 7.1 through the communication channels described in that provision. Refusing or withdrawing marketing consent does not affect applications, invitations or attendance. Acceptance of these Terms is required at the RSVP stage; marketing consent is not.
- Consent to marketing is separate from acceptance of these Terms, image consent and organisational contact details. Providing XPADIA with a participant list, business card, telephone number, email address or other contact details does not by itself constitute marketing consent.
- Consent is exclusively for XPADIA’s marketing. It does not authorise independent marketing by AVATARLAND, Skyfall Warsaw or other partners.
- Marketing consent may be withdrawn completely or limited to a particular communication channel at any time and without charge, using an unsubscribe link provided in a communication where available, replying to an email where technically possible, informing the representative during a marketing call, using the relevant messaging service where applicable, or emailing info@xpadia.com or info@MocneStronyCypru.pl. No reason is required. Withdrawal does not cancel confirmed attendance or result in a charge.
- XPADIA will stop marketing contact through the channel or channels for which consent has been withdrawn. Personal data processed for marketing on the basis of consent will be processed until consent is withdrawn, until the relevant marketing purpose ends or until 6 October 2028, whichever occurs first. Limited information necessary to demonstrate consent history, deal with claims, comply with legal obligations and respect an opt-out may be retained under a separate lawful basis for the period specified in the Privacy Policy; such information may not be used to continue marketing.
- Where an office or assistant's telephone number, email address or other contact detail has been provided, the Participant's declaration is not automatically the consent of the authorised subscriber or user of that channel to receive marketing. Until valid consent from the appropriate person has been obtained, that channel may only be used for organisational contact.
§ 8. Personal data and participant list
- XPADIA is the controller of data collected for registration, guest selection, invitations, RSVPs and the participant list. AVATARLAND handles those data on XPADIA's behalf and according to its instructions. XPADIA has access to applications as needed to assess them and to the complete list of confirmed Participants. Staff receive only the data necessary for their tasks.
- An unsuccessful application is not an entry on the confirmed guest list. Participant lists and application statements are not provided to other guests or partners for their own marketing. Any separate obligations of AVATARLAND as the formal Organiser, particularly concerning complaints and claims, are described in the Privacy Policy.
- XPADIA's marketing use of data is separate from managing the guest list and must remain within a valid lawful basis and the consents for the relevant contact channels. Up-to-date information about consents given or withdrawn is shared together with the data.
- Before data are collected, the Participant receives full privacy information, including the identity of the controller or controllers, their roles and contact details, purposes and lawful bases, recipients, retention periods, data transfers and applicable rights. Where details are provided through an office or assistant, the person concerned also receives the appropriate information in accordance with the law.
- In the circumstances and to the extent provided by the GDPR, data subjects have rights of access, rectification, erasure, restriction, portability, objection and complaint to the competent supervisory authority, including the President of the Polish Personal Data Protection Office. Consent to processing may be withdrawn at any time without affecting the lawfulness of earlier processing based on valid consent.
- Detailed information about personal data processing is provided in the Privacy Policy available on the website alongside these Terms and next to the forms. These Terms do not independently create a lawful basis for unrestricted sharing or marketing use of personal data.
§ 9. Questions and complaints
- Questions, comments and complaints concerning the organisation of or attendance at the Event may be sent to info@MocneStronyCypru.pl or by post to the Organiser's address in § 1. It is sufficient to provide contact details for a response, describe the issue and indicate the desired resolution.
- The Organiser will respond without undue delay and no later than 14 days after receiving a complaint. This does not limit statutory rights or time limits. Personal data requests are handled within the time limits applicable under the GDPR.
§ 10. Final provisions
- These Terms are made available before an application or attendance confirmation is submitted, in a form that can be read and saved. The version accepted when confirming attendance through RSVP is retained for the Participant.
- Updating these Terms does not expand the scope of previously given marketing or image consents. Where a new purpose, recipient, communication channel or period of processing is introduced after consent has already been given, XPADIA will provide the information required by applicable law and, where required, obtain fresh consent before relying on the new processing. For the avoidance of doubt, where a Participant has already provided valid consent covering the communication channels described in § 7.1, the subsequent introduction or use of a particular communication technology falling within that consent does not, by itself, require a new consent, provided that XPADIA complies with all mandatory legal requirements applicable to that communication.
- These Terms have been prepared in Polish and English. Both versions are intended to express the same rules; any discrepancies must not reduce the Participant's statutory protection or expand their consents.
- Matters not covered by these Terms are governed by Polish law, without prejudice to the Participant's rights under mandatory applicable provisions. Jurisdiction is determined by law; these Terms do not require proceedings to be brought exclusively before the court for the Organiser's registered office.
